WARRANTY POLICY

This Warranty Policy applies to products sold by ATRS Pty Ltd (ABN 20 686 423 432) trading as Curve Fitness Australia, operating under the Curve Fitness brand ("Curve Fitness", "we", "us" or "our").
This policy is provided in addition to your rights under the Australian Consumer Law. Nothing in this policy excludes, restricts or modifies any rights or remedies you may have under law.
IMPORTANT ACL NOTICE
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
LIFETIME REPLACEMENT WARRANTY
Where we expressly state on a product page, quote, invoice, order confirmation or warranty document that a product or component carries a Lifetime Replacement Warranty, that statement is a voluntary warranty against defects offered by us in addition to your rights under the Australian Consumer Law.
This voluntary Lifetime Replacement Warranty covers manufacturing defects in the expressly identified covered product or covered component only. It does not apply more broadly than expressly stated.
Unless we expressly state otherwise in writing for the relevant product, lifetime means the period during which the original purchaser owns the covered product, starting on delivery or collection and ending when ownership passes to another person. This voluntary warranty is non-transferable unless required by law.
For an accepted claim under this voluntary Lifetime Replacement Warranty, our remedy is replacement of the defective covered product, covered component, or a substantially equivalent item only. No cash refund is provided under this voluntary Lifetime Replacement Warranty unless required by the Australian Consumer Law.
This voluntary Lifetime Replacement Warranty does not cover normal wear and tear, cosmetic damage not affecting function, surface rust or corrosion, misuse, abuse, neglect, accidental damage, poor maintenance, improper assembly, improper installation, unauthorised modification, use outside the product’s intended purpose, or commercial/high-intensity use of a product sold for home use only.
We may require proof of purchase, photographs, video, measurements, inspection, return of the product, or return of the affected part before finalising a claim.

1. Consumer guarantees and other warranties
Our goods come with consumer guarantees that may apply under the Australian Consumer Law.
Any manufacturer’s warranty, product warranty, extended warranty or lifetime warranty offered in relation to a product is separate from, and in addition to, your rights under the Australian Consumer Law.
Where a product is supplied with a manufacturer’s warranty, that warranty applies in accordance with the manufacturer’s terms.
Where we offer a product-specific standard, extended or lifetime warranty, the applicable warranty period, covered components, exclusions and any special conditions will be the terms expressly stated on the relevant product page, quote, invoice, warranty document or other written confirmation provided at or before the time of sale.
If no specific voluntary warranty period or coverage is expressly stated for a product, no separate voluntary warranty is offered by us for that product beyond your rights under the Australian Consumer Law and any applicable manufacturer’s warranty.
If the term "Lifetime Replacement Warranty" is used for a product, that term applies only to the product or component expressly identified, and has the meaning stated on the relevant product page, quote, invoice or warranty document for that product. It does not apply more broadly than expressly stated.
Unless otherwise expressly stated in writing for a particular product, any voluntary warranty period runs from the date of delivery or collection.

2. What this policy generally covers
Subject to the Australian Consumer Law and any product-specific terms, this policy generally covers:
- manufacturing defects
- faulty materials
- faulty workmanship under normal intended use
- defects in any component or part expressly covered by a product-specific warranty
3. What this policy generally does not cover
Subject to your rights under law, this policy generally does not cover:
- normal wear and tear
- cosmetic marks, scratches, surface rust, finish changes or minor variations that do not affect functionality
- misuse, abuse, neglect or improper storage
- incorrect assembly, incorrect installation or failure to follow instructions
- use outside the product’s intended purpose
- commercial, studio, gym or high-intensity use of a product sold or specified for home use only
- modifications, alterations or unauthorised repairs
- damage caused by weather exposure, corrosion, impact, accident or improper maintenance
- consumable, wearable or replaceable items unless faulty on delivery or otherwise required by law
- damage arising after collection or delivery where caused by self-transport, third-party handling, incorrect installation or use outside the product’s intended specifications
4. Making a warranty claim
To make a warranty claim, please email sales@curvefitness.com.au and include:
- your order number or proof of purchase
- a description of the issue
- clear photos and/or videos showing the issue
- your current contact details
- any other information reasonably requested to assess the claim
You must not dispose of the product or affected part until the claim has been assessed and we have provided further instructions.
We may request further information, inspection, measurements, return of the item, or return of the affected part before finalising the claim.
5. Assessment and remedies
Where a claim is accepted under the Australian Consumer Law, the remedy will be provided in accordance with the law.
Where a claim is accepted only under a voluntary warranty offered by us, the remedy will be the voluntary remedy stated for that warranty. For our voluntary Lifetime Replacement Warranty, that remedy is replacement only.
The remedy offered may depend on the nature of the issue, the age and condition of the product, the applicable warranty terms, whether the issue is major or non-major, and what is reasonable in the circumstances under applicable law.
6. Freight, inspection and other claim costs
Where a product is confirmed to be faulty, not of acceptable quality, or otherwise not compliant with consumer guarantees, we will address the issue in accordance with the Australian Consumer Law.
Where a valid voluntary warranty claim is accepted, we will deal with repair, replacement, parts and any associated costs in accordance with the terms of that warranty and any requirements of law.
If inspection shows that a reported issue is not covered by the Australian Consumer Law or any applicable voluntary warranty, you may be responsible for reasonable freight, inspection, handling, return, re-delivery or replacement costs.
7. Product-specific warranty terms
Some products may have product-specific warranty terms, warranty periods or warranty exclusions stated on the relevant product page, invoice, quote or accompanying documentation.
Where product-specific warranty terms are provided, those terms apply in addition to this policy and your rights under law.
If there is any inconsistency between this policy and a product-specific written warranty term, the product-specific term will apply to the extent of the inconsistency, except to the extent that doing so would limit any non-excludable right under law.
