These Terms and Conditions apply to your use of the Curve Fitness website and to purchases made from ATRS Pty Ltd (ABN 20 686 423 432) trading as Curve Fitness Australia, operating under the Curve Fitness brand ("Curve Fitness", "we", "us" or "our").
By accessing our website, submitting an enquiry, requesting a quote, placing an order, or purchasing from us, you agree to these Terms and Conditions.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
1. Website use
You agree to use this website only for lawful purposes and in a way that does not interfere with the operation, security or availability of the website or the rights of other users.
We may suspend, restrict or withdraw access to the website or any part of it at any time without notice.
2. Product information and website content
We aim to ensure product descriptions, specifications, measurements, colours, pricing, images, availability, shipping information and warranty information are as accurate as reasonably possible. However, errors, omissions and variations may occur.
Images are for general illustration only. Actual products, finishes, packaging and colours may vary.
Statements on the website about promotions, shipping offers, pickup availability, product suitability, warranty periods or warranty coverage apply only where expressly stated and are subject to these Terms, the relevant product page, and any applicable policy or offer terms.
We reserve the right to correct errors, update information, change pricing, withdraw products, limit quantities, or cancel affected orders where reasonably necessary.
3. Quotes, pricing, promotions and payment
Unless otherwise stated, all prices are in Australian dollars and include GST where applicable.
Quoted prices may be time-limited and may change before an order is accepted.
Promotional offers, coupon codes, free-shipping offers, discounts and other website promotions are subject to the specific terms of the relevant offer and may be changed or withdrawn before order acceptance.
Payment must be received in full before dispatch unless we agree otherwise in writing.
We may use third-party payment providers. We are not responsible for the independent terms, conditions or privacy practices of those providers.
3A. Easter Sale, Free Delivery and Same-Day Pickup Offer
During the promotional period stated on our website for the Easter Sale, eligible orders placed through the Site receive a flat 10% discount on the advertised selling price of eligible products, unless a different promotional mechanic is expressly stated on the relevant product page, cart, checkout or offer page.
Unless we expressly state otherwise, the Easter Sale discount is applied automatically at checkout and cannot be combined with any other discount code, coupon, bundle discount, store credit promotion or other offer. The promotion is subject to stock availability and may be amended, suspended or withdrawn before order acceptance.
Any advertised free delivery or same-day pickup offer forming part of the Easter Sale is subject to our Shipping Policy and the conditions below. Free delivery is available only for eligible orders over A$500 delivered to eligible metro postcodes within Melbourne Metro, Sydney Metro, Brisbane Metro, Gold Coast Metro and Adelaide Metro. Mats are always excluded from free-delivery offers.
Same-day pickup is available only for eligible in-stock items located at selected warehouse pickup locations within Melbourne Metro, Sydney Metro, Brisbane Metro, Gold Coast Metro and Adelaide Metro, after payment has cleared in full and after we issue pickup-ready confirmation. Same-day pickup is not guaranteed and remains subject to cut-off times, stock-location accuracy, staffing, safety checks and operational capacity.
Free delivery and same-day pickup are not available for regional, rural, remote or ineligible postcodes or locations unless we expressly confirm otherwise in writing.
Nothing in this section limits your rights under the Australian Consumer Law.
4. Orders and order acceptance
Submitting an order, requesting a quote, or accepting a quote does not guarantee acceptance.
All orders are subject to acceptance, product availability, freight feasibility and payment clearance.
An order is accepted only when we confirm acceptance or dispatch the goods, whichever occurs first.
We may decline or cancel an order where reasonably necessary, including where there is a pricing error, stock issue, suspected fraud, delivery limitation, or other genuine issue affecting fulfilment. If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.
5. Delivery and pickup
Delivery and pickup are subject to our Shipping Policy, which forms part of these Terms. Estimated dispatch, delivery and pickup-ready timeframes are estimates only and are not guaranteed unless otherwise required by law.
Any advertised shipping offer, free-delivery promotion or pickup option is subject to product, postcode, stock, carrier and location restrictions, and to any specific terms published with that offer.
Pickup is only available for selected products and locations where confirmed by us. Same-day pickup, where advertised, is available only on the specific terms stated in the relevant offer or Shipping Policy.
You are responsible for ensuring access is suitable and safe for delivery or pickup, including stairs, lifts, accessways, clearances and site restrictions.
6. Risk and title
Risk in goods passes to you when the goods are delivered to the delivery address, collected by you, or collected by your nominated carrier, as applicable.
Title to goods remains with us until payment has been received in full and cleared.
7. Returns, refunds and warranty
Our Returns & Refunds Policy and Warranty Policy form part of these Terms.
Product-specific warranty periods and coverage, including any standard, extended or lifetime warranty offered on selected products, apply only where expressly stated on the relevant product page, in the relevant policy, or in any warranty document supplied with the product.
Any warranty offered by us or applicable to a product is in addition to your rights under the Australian Consumer Law.
Where a product is supplied with a warranty against defects, the terms of that warranty, including claim steps, claim periods, inclusions, exclusions, available remedies, and responsibility for any costs associated with a claim, are set out in the relevant Warranty Policy, product page and/or warranty document provided with the product.
Nothing in our Returns & Refunds Policy, Warranty Policy, or these Terms limits your rights under the Australian Consumer Law.
8. Australian Consumer Law
Our goods and services come with consumer guarantees that may apply under Australian law.
Depending on the nature of the issue, you may be entitled to a repair, replacement, refund, re-supply, compensation or another remedy available at law.
9. Limitation of liability
To the fullest extent permitted by law, and subject always to clause 8, we are not liable for indirect, consequential, incidental or special loss arising from use of the website or from delay, interruption or unavailability.
Where liability cannot be excluded, our liability is limited to the extent permitted by law.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
10. Intellectual property
Unless otherwise stated, all content on this website, including text, graphics, product descriptions, branding, logos, layouts, photographs and other materials, is owned by us or licensed to us.
You must not reproduce, republish, distribute, adapt, exploit or use website content for commercial purposes without our prior written consent, except as permitted by law.
11. Third-party links and services
This website may contain links to or integrations with third-party websites, platforms or services. Those third parties operate independently and may have their own terms and privacy policies.
We are not responsible for the content, conduct or practices of third-party sites or services.
12. Privacy
Our collection, use and disclosure of personal information is governed by our Privacy Policy.
13. Changes to these Terms
We may update these Terms from time to time by publishing the updated version on our website. The version published at the time of your order will generally apply to that order unless otherwise required by law.
14. Governing law
These Terms are governed by the laws of Victoria, Australia.
You submit to the non-exclusive jurisdiction of the courts of Victoria and any courts hearing appeals from them.
15. Good Friday Appeal campaign terms and conditions
15A. Campaign summary

15B. Treatment summary of eligible order total and refunds
- The 2% contribution will be calculated on the eligible order total only
- Shipping charges, gift cards, finance charges and assembly or service fees are excluded from the eligible order total
- Cancelled orders, fully refunded orders, fraudulent transactions and chargebacks do not count
- If an order is partially refunded, the contribution may be reduced proportionately to the revised eligible order total
- Orders delivered outside Victoria do not qualify for this campaign
15C. Promoter
This campaign is conducted by ATRS Pty Ltd trading as Curve Fitness Australia at curvefitness.com.au.
15D. Campaign period
The campaign starts on 1 April 2026 and ends on 10 April 2026 (AEST/AEDT, as applicable).
15E. Donation mechanic
During the campaign period, Curve Fitness will forward 2% of each eligible order total to the Good Friday Appeal for each eligible order placed through curvefitness.com.au and delivered to a Victorian address during the campaign period.
15F. Eligible orders
Eligible orders are orders for products sold on curvefitness.com.au during the campaign period that are delivered to a Victorian address. Orders delivered outside Victoria are excluded from this campaign.
15G. Excluded amounts and transactions
The following are excluded from the eligible order total or otherwise do not count toward the campaign:
- shipping charges
- gift cards
- finance charges
- assembly or service fees
- cancelled orders
- fully refunded orders
- fraudulent transactions
- chargebacks
- orders delivered outside Victoria
15H. Refund treatment
A campaign contribution is counted only for an order that is successfully paid and not later cancelled or fully refunded. If an order is fully refunded, no contribution will be counted for that order. If an order is partially refunded, the contribution may be reduced proportionately to the revised eligible order total.
15I. No cap
There is no maximum total contribution cap for this campaign unless these terms are updated or the campaign is withdrawn in accordance with clause 12.
15J. No customer surcharge
The campaign contribution is made by Curve Fitness. Customers are not charged an additional donation amount as part of this campaign unless expressly stated otherwise.
15K. Remittance timing
Curve Fitness will reconcile eligible orders after the campaign ends and remit the final campaign amount to the Good Friday Appeal within 14 days after the end of the campaign.
15L. Use of name and materials
Use of the Good Friday Appeal name, logo, or related promotional material is subject to approval and consent from the Good Friday Appeal.
15M. No endorsement
This campaign must not be taken to imply endorsement by the Good Friday Appeal or The Royal Children’s Hospital of Curve Fitness or its products or services.
15N. Changes, suspension or withdrawal
Curve Fitness may amend, suspend or withdraw the campaign if required by law, to correct an error, or to comply with any condition of approval or consent relating to the campaign. Any updated terms will be published on curvefitness.com.au.
15O. Australian Consumer Law
Nothing in these campaign terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.
