RETURNS & REFUNDS POLICY

This Returns & Refunds Policy applies to products sold by ATRS Pty Ltd (ABN 20 686 423 432) trading as Curve Fitness Australia, operating under the Curve Fitness brand ("Curve Fitness", "we", "us" or "our").
Nothing in this policy excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
IMPORTANT ACL NOTICE
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
120-DAY HOME TRIAL
Our 120-Day Home Trial is a voluntary change-of-mind policy offered in addition to your rights under the Australian Consumer Law.
Subject to this policy, we may approve a return request made within 120 days after delivery or collection for an eligible product purchased from us for indoor domestic home use.
To be eligible, the product must:
- have been used only for reasonable indoor domestic trial use and inspection
- be returned clean, complete and in saleable condition
- include all original parts, hardware, accessories and manuals
- not be broken, structurally damaged, heavily worn, stained, rusted, modified or missing parts
- not have been used in a commercial gym, studio, shared facility or other non-domestic environment
- not be a product expressly marked on the product page, quote, invoice or order confirmation as excluded from the 120-Day Home Trial
- be approved by us before return
For this policy, saleable condition means the product is clean, safe, complete, and reasonably capable of resale without repair other than ordinary cleaning and reboxing.
Approved 120-Day Home Trial returns are subject to inspection after return. Unless required by law, we may refuse the return or apply reasonable deductions for missing packaging, cleaning, missing parts, damage, excessive wear, loss in value, outbound freight already incurred, return freight, collection, handling, reboxing and restocking.
Original outbound shipping charges are not refundable for change-of-mind returns unless required by law. Return freight and collection costs for change-of-mind returns are the customer’s responsibility unless we agree otherwise in writing.
Nothing in this policy limits your rights under the Australian Consumer Law.
1. Approved change-of-mind returns
The 120-Day Home Trial section above states our voluntary change-of-mind return policy for eligible products.
Any approved change-of-mind return is subject to inspection after return. Unless required by law, we may refuse the return or apply reasonable deductions for missing packaging, cleaning, missing parts, damage, excessive wear, loss in value, outbound freight already incurred, return freight, collection, handling, reboxing and restocking.

2. Restocking and return deductions
For approved change-of-mind returns, we may deduct a reasonable amount to reflect:
- outbound freight already incurred
- return freight or collection costs
- restocking or handling costs
- loss in value caused by missing packaging, wear, damage or incomplete return
Any such deduction will be assessed reasonably and consistently with your rights at law.
3. Faulty, damaged, incorrect or missing items
If your order arrives faulty, damaged, incorrect or incomplete, contact us as soon as reasonably possible with:
- your order number
- a description of the issue
- clear photos or videos where possible
Prompt notice helps us assess the issue and, where relevant, investigate with the freight provider.
Where a product does not meet applicable consumer guarantees, you may be entitled to a repair, replacement, refund, compensation or another remedy available under law.
4. Major and non-major problems
Where the law applies, remedies may depend on whether the problem is major or non-major.
For major problems, you may be entitled to reject the goods and choose a refund or replacement.
For non-major problems, we may be entitled to repair or replace the goods within a reasonable time before a refund is required.
5. Return process
Do not send goods back without approval.
To request a return, email sales@curvefitness.com.au with your order details and the reason for return.
If a return is approved, we will provide return instructions. In some cases we may request additional photos, videos, inspection details or other information before approving a return.
Returned goods must be packaged safely to prevent transport damage. We are not responsible for items damaged in return transit due to inadequate packaging.
6. Non-returnable items
Unless required by law, we may refuse returns for:
- items returned in a condition that is inconsistent with the permitted indoor domestic trial use allowed under the 120-Day Home Trial section above
- items returned without original packaging where resale is not reasonably possible
- custom-made or special-order products
- clearance or final-sale items
- products damaged after delivery or collection due to misuse, neglect, improper storage, improper installation or unauthorised modification
7. Refund timing
Where a refund is approved, it will generally be processed to the original payment method unless otherwise agreed.
Processing times may vary depending on the payment provider, bank or platform used.
8. Chargebacks
If you have a problem with an order, please contact us first so we can try to resolve it.
Where a chargeback is initiated while goods are still in your possession, we reserve our rights in relation to the goods, payment dispute and recovery process.
